Omni Arena Contest Rules
Divrgence Entertainment LLC (“Divrgence”) — Huntsville, Alabama
These Official Rules govern the Omni Arena prize contests (“Contests”) run by Divrgence Entertainment LLC, dba Divrgence (“Divrgence,” “we,” or “us”), at our Huntsville, Alabama location (the “Venue”). By entering or playing in a Contest, you agree to these Official Rules. If you have questions, contact us at contact@thedivrgence.com.
1. Eligibility
To participate in a Contest, you must:
● Have a valid Omni Arena user account in good standing;
● Be at least 13 years old. If you are under 18, your parent or legal guardian must accept these Official Rules on your behalf, and any prize you win will be awarded in their name;
● Be a natural person (not a company or organization); and
● Play the Contest Game at the Venue during the Contest Period — gameplay elsewhere does not count.
Divrgence staff and their immediate family members are not eligible to win prizes. Divrgence may, at its discretion, verify eligibility before awarding any prize, and may deem a participant ineligible at any time.
2. Teams and Play
Contests may involve individual play or teams of up to four players, depending on the Contest Game. A player may only be on one team per Contest; if you play on more than one, only your highest-scoring team is eligible for a prize. Only teams where every member is logged into their own account (no guest play) are eligible. Player usernames must be appropriate — Divrgence may require a name change or ban inappropriate usernames.
3. Health and Safety Acknowledgment
The Virtuix Omni is a physical device that requires moderate to heavy physical exercise. By playing, you confirm that you are healthy enough to participate, and you agree not to use the Omni if you are pregnant, intoxicated, epileptic, or recovering from major surgery, illness, or a heart attack. The Omni is intended for users between 4’2” (128 cm) and 6’5” (195 cm) tall and up to 285 lbs (130 kg). Sessions should not exceed one hour. Some players may experience dizziness, disorientation, or (rarely) seizures from VR content, even with no prior history. Stop immediately and notify Venue staff if you feel unwell, and consult a physician before playing if you have any relevant health concerns.
4. Format, Schedule, and Cost
Contest dates, times, and the specific Contest Game will be posted at the Venue. Any Eligible Participant who plays the Contest Game at the Venue during the Contest Period is automatically entered; scores are tracked by the game’s internal scoring system, which is final. Standard per-play pricing at the Venue applies to Contest gameplay — Divrgence does not reimburse entry costs or costs related to hardware, software, or connectivity issues.
5. Prizes
● Winners will be notified in person or by the contact info on file and must claim their prize within two weeks, or forfeit it.
● Prizes are not exchangeable, transferable, or redeemable for cash, unless Divrgence decides otherwise.
● For team prizes, each eligible team member is responsible for claiming their share.
● Divrgence may publish a winner’s name and photo in connection with the Contest.
● Divrgence may cancel or modify a Contest, or the prizes offered, at any time.
6. Conduct
All participants are expected to show good sportsmanship and fair play. The following are grounds for disqualification and removal from the Venue:
● Cheating, including account sharing, interfering with other players’ equipment or connections, or faking Omni movement by hand;
● Harassment, discrimination, hate speech, or obscene/abusive language or gestures;
● Threats or violent behavior toward other players, staff, or spectators;
● Gambling on Contest outcomes; and
● Any other behavior Divrgence reasonably deems disruptive or unsafe.
Divrgence has sole discretion to investigate suspected violations and to disqualify a player or team, at any time, with no obligation to reimburse any costs already incurred.
7. Use of Your Name, Likeness, and Data
By participating, you grant Divrgence a non-exclusive, royalty-free right to use your name, username, likeness, photo, and gameplay statistics to promote the Contest and Divrgence (for example, on our website, social media, or in-store signage). Divrgence will collect and use the personal information needed to run the Contest (such as your account email) consistent with our privacy practices, and will not sell your information to third parties.
8. Release and Limitation of Liability
To the fullest extent permitted by Alabama law, by participating you release Divrgence, its owners, and employees from liability for injuries, losses, or damages arising from the Contest or your use of the Venue’s equipment, except to the extent caused by Divrgence’s gross negligence or willful misconduct. Any dispute arising from a Contest will be handled individually (not as a class action), and any recovery is limited to your actual, direct out-of-pocket costs.
9. General Terms
Divrgence may change these Official Rules or suspend or cancel a Contest at any time, at its discretion. Divrgence’s decisions on all Contest matters, including scoring, eligibility, and disqualification, are final. These Official Rules are governed by the laws of the State of Alabama, and any dispute will be resolved in the state or federal courts located in Madison County, Alabama. If any provision of these Official Rules is found unenforceable, the remainder will stay in effect. “Omni Arena” and “Virtuix” are trademarks of their respective owners; nothing here grants you rights to use them.
